INFORMATIVE REPORT

 

Article 13 of Regulation (EU) 2016/679
General Data Protection Regulation

 

Pursuant to Article 13 of the EU Regulation 679/2016 General Data Protection Regulation ('GDPR'), the Data Controllers, identified below, wish to inform you as follows about the processing of your personal data provided in the course of participation in the 'Gardener Types' survey (hereinafter the 'Wizard')


1. THE DATA CONTROLLER and DPO:
The Joint Data Controllers, on the basis of a co-ownership agreement drawn up pursuant to Article 26 of the GDPR, the essential contents of which are available to you upon request to be sent to the e-mail address: privacy.legal@stiga.com, are the following companies:
- the Italian law company Stiga S.p.A., with registered office in 31033 - Castelfranco Veneto (TV), Italy, via del Lavoro no. 6, fiscal code and VAT no.: 07684381002, e-mail privacy.legal@stiga.com;

2. PURPOSE AND LEGAL BASIS OF PROCESSING:
Your personal data (such as first name and surname, email address, data relating to your Stiga product, picture of your garden (optional), country and city, Instagram account (optional), data contained in / relating to the answers to the Survey) will be processed in accordance with the applicable data protection legislation for the following purposes:


2.1. Allow and manage your participation in the Survey
The personal data you provide when taking part in the published Survey will be processed to enable and manage your participation in it.
The legal basis for the processing is your consent that you provide to us by continuing with your participation in the Survey. Consent is optional and always revocable by writing to privacy.legal@stiga.com, without prejudice to the lawfulness of the processing carried out prior to such revocation (pursuant to Article 6(1)(a) of the GDPR). 


2.2. Marketing purposes 
In the event that you provide your specific consent, the Data Controllers may process your personal data for marketing purposes, i.e. to send you commercial and promotional communications relating to products and services offered by Stiga, as well as to its events, promotions, updates on the latest technologies, and to participate in surveys and market analysis - through the use of newsletters, e-mails, paper mail, telephone contact, text messages, instant messages, posts, communications and posts on social networks.
The legal basis for data processing is your consent (pursuant to Article 6, first paragraph, letter a) of the GDPR). Consent is optional and always revocable by requesting us to stop processing for marketing purposes by writing to: unsubscribe@stiga.com, or, with reference to the Stiga Newsletter, by clicking on the appropriate link contained in each promotional e-mail, without prejudice to the lawfulness of the processing carried out prior to such revocation. 
Failure to provide consent for marketing purposes will in no way affect the possibility of participating in the Survey.

 

3.    DATA PROCESSING METHODS:
The processing of personal data shall take place mainly with the support of computer or telematic means in compliance with current legislation and, in any case, in such a way as to guarantee their security and confidentiality and to prevent their unauthorised disclosure or use, alteration or destruction.
We ask you to provide the data/answers indicated as mandatory by an asterisk (*) as they are necessary for participation and completion of the Survey. However, failure to provide optional data will have no effect on your participation in the Survey.

 

4.    RECIPIENTS OF PERSONAL DATA :
For the pursuit of the purposes described in point 2 above, your personal data will be made known (limited to their respective sphere of competence) to the personnel of the Data Processors who will act as persons authorised to process personal data, specifically designated for this purpose.
In addition, your personal data may be disclosed to: 
- Suppliers of the technological infrastructure used for the implementation of the Survey and related technical and organisational services (e.g. supplier of portal and IT application and related users; implementation and management of Survey, website management, etc.); 
- parties commissioned by us to produce and send promotional and marketing material;
- parties that provide services relating to the management of the technological infrastructure and information systems of the companies; 
By writing to privacy.legal@stiga.com you can request the list and details of the persons appointed as data processors pursuant to Article 28 of the GDPR. 

 

5.    EXTRA EU TRANSFERS:

In pursuance of the purposes described in point 2 above, your personal data may be transferred to countries outside the European Union, such as the USA and the UK, where some of our sub-contractors and their systems used for the purposes of conducting the Survey and related data management are located.  The transfer of data to non-EU countries will take place in full compliance with the safeguards (such as the EU Commission's adequacy decision of 28 June 2021 for the UK; the adherence of our sub-contractors to the EU-US Data Privacy Framework or the signing of the Standard Contractual Clauses referred to in the European Commission's Decision No. 2021/914), measures and rights as provided by the GDPR. By simple request to privacy.legal@stiga.com, you will be able to receive information on the safeguards adopted to enable the lawful transfer of your data, as well as on the means of obtaining them or the place where they are made available.


6.      DATA RETENTION PERIOD:
Personal data processed:
- for the purposes set out in point 2.1.: they will be kept for the time necessary to manage your participation in the Survey. In any event, data will not be processed for a period exceeding 12 months after the conclusion of the Survey;
- For the purpose of 2.2: will be processed until your consent is revoked or you object to direct marketing activities. 
After that, the Data will be deleted or may only be processed following the adoption of technical measures that do not allow your identity to be traced. 

 

7.     YOUR RIGHTS AS A DATA SUBJECT:
By writing to privacy.legal@stiga.com you will be able to exercise, vis-à-vis each data controller, the rights recognised by Articles 15 to 22 of the GDPR, including, in summary, the right to obtain access to your personal data or their deletion or restriction; request to receive or transmit to another data controller your data in a structured, commonly used and machine-readable format. 
You may also always revoke your consent, without prejudice to the lawfulness of the processing carried out prior to revocation, and object, on grounds relating to your particular situation, to the processing of personal data relating to you carried out, for example, in pursuit of a legitimate interest of the controller or a third party. You may also always object to the processing of data carried out for direct marketing purposes, including profiling related to such direct marketing, where carried out.

We remind you that, if you consider that the processing that concerns you violates the provisions of the GDPR, you may always lodge a complaint with the Data Protection Authority (www.garanteprivacy.it), or, if different, with the Data Protection Authority of the Member State where you habitually reside or work or of the place where the alleged violation occurred.
